A Federal Appeal , filed in the United States Court of Appeals for the Fifth Circuit, under 21-50050, which received no service to the defendants listed, in District Court, was dismissed today, March 9, 2021.
This occurred after the Appellees in the cause raised concerns they were not served at the District Court level.
The Appellant agreed the Appellees should have received service in the initial filing at the District Court level.
The appeal was to obtain service; however, the Appellant agreed it was easier to dismiss the appeal and refile the cases separately. One case has already been refilled and the involved parties have been sent notification to such.
