Earlier today, the Hidalgo County Sheriff’s Office announced the arrest of two former Detention Officers, 26-year-old Alan Omar Jalomo and 26-year-old Malik John William Lee, who were both employed at the Hidalgo County Adult Detention Center. The arrests were made at the Hidalgo County Sheriff’s Office for Official Oppression, a Class A Misdemeanor.

The arrests come in response to an investigation initiated by HCSO following excessive use of force complaints against Jalomo and Lee. The investigation findings revealed that both individuals had assaulted inmates while in their official capacity.

In response to these findings, the Hidalgo County Sheriff’s Office reaffirmed its commitment to upholding the trust and confidence of the public. The investigation concluded that the use of force by Jalomo and Lee against the inmates under their care and custody was unjustified.

Hidalgo County Sheriff’s Office Reports Incidents to FBI

The Hidalgo County Sheriff’s Office has stated its intention to take necessary and appropriate actions to ensure accountability and transparency to the public and the citizens they serve. Moreover, they have fulfilled the requirement to notify the Federal Bureau of Investigation under Section 1983 for possible Civil Rights Violations.

As a result of the arrests, Jalomo was issued a $5,000 personal recognizance bond for one count of official oppression. Lee was issued two $5,000 personal recognizance bonds for each of his official oppression charges.

What is Official Oppression in Texas

In the state of Texas, the official oppression law, as detailed in Sec. 39.03, addresses the actions of public servants in the course of their official duties. A public servant can be held accountable for committing an offense under this law if certain conditions are met. These conditions encompass intentional mistreatment or the unlawful act of arresting, detaining, searching, seizing, dispossessing, assessing, or placing a lien on another individual.

It is essential that the public servant is aware of the unlawfulness of their actions for this provision to apply. Furthermore, intentionally denying or impeding another person from exercising or enjoying their rights, privileges, powers, or immunities, while having the knowledge that such conduct is unlawful, constitutes an offense under this law. Additionally, intentionally subjecting another individual to sexual harassment is considered a violation, emphasizing the prohibition of such behavior within the scope of this law.

For the purpose of the section, a public servant is deemed to be acting under the color of his office or employment if he performs or purports to perform official duties or takes advantage of such actual or purported capacity. This provision delineates the circumstances under which the official oppression law is applicable to the actions of public servants.

The law further defines “sexual harassment” as encompassing unwelcome sexual advances, requests for sexual favors, or any other verbal or physical conduct of a sexual nature. Moreover, submission to such conduct is considered a term or condition of a person’s exercise or enjoyment of any right, privilege, power, or immunity, whether explicitly or implicitly.

An offense under the section is classified as a Class A misdemeanor, except in cases where the public servant’s actions were intended to impair the accuracy of data reported to the Texas Education Agency through the Public Education Information Management System (PEIMS) as prescribed by the Education Code. In such instances, the offense is elevated to a felony of the third degree. The provision underscores the seriousness with which the state of Texas regards the accuracy and integrity of reported education-related data, imposing stringent consequences for any deliberate attempts to compromise this information.
