AG Paxton Tots Victory, Almost Immediately Losses – SB 4

On March 19, 2024, Texas Attorney General Ken Paxton issued a victorious press release after the US Supreme Court withdrew its stay order on SB 4; however, soon after, the Fifth Circuit also withdrew its stay of the enforcement of the US District Court’s order, claiming the law was unconstitutional. This put the enforcement of SB 4 back on pause.

AG Paxton Celebrates SB 4 To Early

Attorney General Paxton celebrated a significant win as the US Supreme Court lifted its temporary halt on SB 4, Texas’s immigration law. The Court’s decision denied emergency requests from the Biden Administration and various organizations to block the law’s enforcement, effectively allowing Texas to implement SB 4 immediately. However, the victory was short-lived as the Fifth Circuit subsequently lifted its stay on the enforcement of the US District Court’s ruling, which deemed the law unconstitutional. This action once again suspended the enforcement of SB 4.

AG Paxton Emphasizes Importance of SB 4

In a press release, Attorney General Paxton emphasized the necessity of SB 4 in addressing the ongoing challenges at the Texas-Mexico border. The law criminalizes illegal border crossings at the state level, complementing existing federal statutes. SB 4 empowers Texas law enforcement to detain undocumented individuals and enables judges to mandate their return to their country of illegal entry. Paxton reiterated that the law was designed to safeguard Texas’s sovereignty without conflicting with federal regulations.

Following the Supreme Court’s decision, Attorney General Paxton expressed his commitment to defending Texas and leading the state to victory in the legal arena. Despite the subsequent setback, Paxton highlighted the immediate implementation of SB 4 as a testament to Texas’s resolve in addressing immigration issues.

This sequence of events underscores the complex legal and jurisdictional dynamics surrounding SB 4 and exemplifies the ongoing clash of interests between state and federal authorities in the realm of immigration enforcement.
